The Liège Court of Appeal rejected last week the request of 19,736 owners of photovoltaic panels who wanted compensation from the Walloon Region, reported Tuesday L’Echo, which was able to read the judgment.
The plaintiffs accused the Walloon Region of having betrayed them by retroactively reducing the period for granting the green certificates from 15 to 10 years. The Walloon government justified this decision by the success of public support between 2008 and 2011 and the swelling of the photovoltaic “bubble” that this had caused. This in fact resulted in an increase in the electricity bill for all consumers.
Some 79,000 installations were affected and more than 19,000 owners, most of whom were part of the TPCV association (Don’t Touch My Green Certificates), which has since become Beprosumer, then decided to challenge the Walloon government’s decision in court. The court of first instance of Liège dismissed them in 2021 but these owners then appealed. The Court of Appeal has therefore just rejected their request for compensation. In particular, she contested the fact that panel owners had been guaranteed that the support system would not change over time.
