Naxoo case in Geneva: the Federal Court confirms

Cable has a bad reputation. And we know it’s not for nothing. After having, for example, tried to curb Swisscom’s digital TV by continuing to invoice subscriptions in the tenants’ charges, Naxoo tried to curb competition from satellite installers in Geneva.

This time, it is the Federal Court which definitively condemns the actions of Naxoo, while reducing the fine imposed on the cable network, which was formerly available to UPC. In question of actions once morest the installation of antennas to receive satellite TV, as recalled in this judgement.

Abuse of dominant position

As we have already explained here, the Geneva cable operator was sanctioned for having prevented an installer of satellite antennas from using the connections of the buildings to the cable TV network. All shots have been allowed for too long, but it’s over, at least in this area.

This umpteenth episode spices up a long legal saga. In 2018, the Competition Commission (Comco) imposed a fine of 3.5 million francs. In 2021, the Federal Administrative Court had reduced the fine to 3.2 million. A sum reduced to 3.1 million, according to this dispatch of the ATS.

Abuse of dominant position…

My comment? This umpteenth judgment confirms that the telecoms market is too often limited by abuse of a dominant position. Too often the large companies of the place prevent their small competitors from existing or from living. A sad mentality that continues today…

What to think, for example, of certain massive price increases that are more or less justified, but often linked to particular positions on the market? Brief. Once once more, we can wonder if competition really works in this very particular Swiss telecom market…
