Navigating Road Damage Compensation: Procedures, Evidence, and Sofico’s Role

The problem many motorists face is the burden of proof. Some damage is not immediately visible – a slow puncture due to a pothole for example. It is then more complicated to obtain compensation. When an accident occurs, it is not always easy to determine whether the cause is linked to the state of the roads or to another cause. Especially since the complainant must provide, in particular, photos and a quote made by a mechanic. “It is, however, obvious that when the circumstances of the accident are not clear and the following-effects suffered by the parties are serious, the case is brought before the courts which will determine the various responsibilities and the amount of compensation, if there is any. takes place,” explained the Walloon Minister in charge of Road Infrastructure, Philippe Henry (Ecolo) to a Walloon MP who questioned him regarding the procedures to follow.

The minister also recalled that all the information relating to these procedures is available on the website of the Walloon Region, in the Mobility and infrastructure section. He also specifies that an application has been implemented at the administration level to speed up the processing of files. “Nearly half of the complaints received are the subject of amicable compensation within the framework of a transaction,” finally explains the minister. Which announces that the creation of an application for users is currently being designed.

Sofico decides

Please note that in the case of an amicable procedure, it is up to Sofico to judge whether the evidence provided is sufficient. “In addition, different circumstances may result in total or partial exemption from Sofico’s liability (such as, for example, the fault of the victim),” explains the public company on its website.

These 2.7 million compensation paid in 2022 represent 350 complaints mainly linked to the state of the roads and signaling. A decreasing figure while the amounts of compensation increase. For example, in 2013, 699 complaints were deemed admissible for a total amount of compensation of 372,000 euros. In 2015, 205 complaints were admissible for an amount of 520,000 euros in compensation.
