HAVING SEEN File No. EX-2024-34532358-APN-GA#INCAA of the Registry of the NATIONAL INSTITUTE OF CINEMA AND AUDIOVISUAL ARTS, Laws No. 17,741 (to 2001) and No. 24,156 and, Decrees No. 1536 dated August 20, 2002, No. 202 dated February 28, 2024 and No. 662 dated July 23, 2024, INCAA Resolutions No. 1477-E dated November 22, 2017 and its amendments, No. 27-E dated April 9, 2024, No. 328-E dated June 26, 2024, No. 447-E dated dated July 26, 2024, No. 453-E dated July 30, 2024, No. 472-E dated August 2, 2024 and No. 520-E dated August 14, 2024, and

CONSIDERING:

That Law No. 17,741 (to 2001) and its amendments establishes that the NATIONAL INSTITUTE OF CINEMA AND AUDIOVISUAL ARTS is in charge of promoting and regulating cinematographic activity throughout the Territory of the Republic, and abroad, as regards national cinematography, in accordance with the provisions established by the law itself.

That Article 3 of Law No. 17,741 (to 2001) and its amendments establishes the duties and powers of the President of the NATIONAL INSTITUTE OF CINEMA AND AUDIOVISUAL ARTS.

It is the power of the highest authority of the Agency to establish measures to promote film activity and other audiovisual media.

That it is an essential requirement to carry out the promotion measures established in Law No. 17,741 (to 2001) and amendments and Decree No. 1536/2022 to take into account the provisions of article 33 of Law No. 24,156 which states: “Commitments for which there are no available balances of budget credits may not be acquired, nor may the credits be used for a purpose other than that intended.”

That, in this sense, by virtue of the existing budgetary and financial deficit, and with the objective of restoring the necessary balance so that this Institute can finance itself with its own income, INCAA Resolution No. RESOL-2024-27-APN-INCAA#MCH was issued, which suspended the reception of all types of projects for a period of NINETY (90) days from the day of its publication and determined that the projects presented for evaluation and did not have a resolution issued by the Agency granting them a subsidy by digital documentary means, and that do not yet have a digital committee assigned, will be returned to the presenters.

That, without prejudice to the above, these last projects may be presented again once the suspension period ends.

That the suspension period established in the aforementioned Resolution had the objective of promoting new regulations for audiovisual promotion in order to adapt to the needs of the current world in pursuit of dynamics and agility in accordance with the new times.

That since the issuance of INCAA Resolution No. RESOL-2024-27-APN-INCAA#MCH, the NATIONAL INSTITUTE OF CINEMA AND AUDIOVISUAL ARTS began to work on a new promotion plan.

To this end, the following were issued, among others: (i) INCAA Resolution No. RESOL No. 2024-328-APN-INCAA#MCH, which approves the new regulatory framework for special audiovisual promotion programs for the provinces, (ii) RESOL-2024-447-APN-INCAA#MCH, which approves the Regulations for the selection and operation of Juries and Committees, (iii) RESOL No. 2024-453-APN-INCAA#MCH, which approves the General Guidelines for Contests and Awards.

That the following Contests were also called: a) 14TH FEDERAL COMPETITION FOR THE DEVELOPMENT OF THE FEATURE FILM PROJECT “RAYMUNDO GLEYZER 2024-2025” and b) “COMPETITION FOR FINISHED AUDIOVISUAL FICTION AND/OR ANIMATION SCREENPLAY” as stated in INCAA Resolutions No. RESOL-2024-472-APN-INCAA#MCH and No. RESOL-2024-520-APN-INCAA#MCH respectively.

That the Agency continues to issue regulations and implement new rules that favor audiovisual promotion.

That, therefore, it is necessary to extend the suspension established by INCAA Resolution No. RESOL-2024-27-APN-INCAA#MCH with regard to digital documentary projects governed by INCAA Resolution No. RESOL-2017-1477-APN-INCAA#MC.

That an administrative act should be issued in this regard.

That the DEPUTY MANAGEMENT OF PROMOTION, the PUBLIC POLICY MANAGEMENT, the GENERAL MANAGEMENT and the LEGAL AFFAIRS MANAGEMENT have taken the intervention that is their responsibility.

That the power to issue this Resolution arises from Law 17,741 (to 2001), and its amendments and Decrees No. 1536/2002 and No. 202/2024.

Therefore,

THE PRESIDENT OF THE NATIONAL INSTITUTE OF CINEMA AND AUDIOVISUAL ARTS

RESOLVES:

ARTICLE 1.- Extend INCAA Resolution No. RESOL-2024-27-APN-INCAA#MCH for digital documentary projects that fall within the terms of INCAA Resolution No. RESOL-2017-1477-APN-INCAA#MC and its amendments, for a period of SIXTY (60) days from the date of its publication.

ARTICLE 2°.- Establish that this Resolution will enter into force upon its publication in the Official Gazette.

ARTICLE 3.- Register, communicate, publish, give to the NATIONAL DIRECTORATE OF THE OFFICIAL REGISTRY and file in a timely manner.
