National Council decides: Raser cars can be expropriated

2023-07-05 16:10:00

In itself, a three-stage system is envisaged, ranging from provisional confiscation to confiscation to forfeiture of the vehicle. People who drive 60 km/h too fast in town and 70 km/h too fast in the country will in future be able to have their car taken away entirely. If the speed is exceeded by more than 80 km/h (in urban areas) or 90 km/h (outdoors) under certain circumstances, even a single violation can lead to the vehicle being destroyed.

As Minister of Transport Leonore Gewessler (Greens) explained, the vehicles will be auctioned off. 70 percent of the proceeds go to the traffic safety fund, the rest to the respective local authority. If the car does not belong to the driver, he will be permanently banned from driving the vehicle.

Green traffic spokesman Hannes Weratschnig said that tough sanctions would be needed if speeding became a danger to the general public. This is not a trivial offense. His VP colleague Andreas Ottenschläger emphasized that a car is an important means of mobility for many: “But it’s not a toy on the road.” If the car becomes a weapon because it is misused, then ultimately it must “be gone at some point”.

SPÖ in line with the coalition

For once, the SPÖ was completely in line with the coalition. Her mandatary Dietmar Keck argued that driving license withdrawals would do nothing for extreme speeders, since they would continue – and “fines make them proud.” But their cars are sacred and if you take them away from them, that’s the only way to save lives.

Gewessler reminded that such traffic behavior also means a danger for bystanders: “Every single case is unbearable.”

The NEOS were also interested in combating speeders, but they did not get through to an agreement. Justice spokesman Johannes Margreiter stated legal concerns. He thinks that the VfGH will not play along because there is a much too strong distinction between motorways and urban areas.

“What if the Ferrari was wrongly auctioned off?”

VIENNA. Amendment: Anyone who speeds on the Autobahn at more than 180 km/h should lose their driver’s license immediately

“What if the Ferrari was wrongly auctioned off?”

The liberal traffic spokesman Gerhard Deimek asserted legal problems and failed international role models and presented himself as the patron saint of motor vehicles: “Cars are neither weapons nor as such evil and dangerous.” He suggested increasing the speed on the autobahns like in Italy. That would be something decent, thinks Deimek.
