National Assembly: Bill on number of judges postponed

Pakistan The National Assembly has postponed the bill regarding the number of judges on Tuesday. In this bill, the total number of judges of the Supreme Court has been asked to be 23.

National Assembly During the session, when PML-N leader Daniyal Chaudhry presented the bill related to the number of judges, the opposition faced opposition, after which the bill was postponed.

PML-N leader Daniyal Chaudhry while talking about the bill said that the number of cases pending in the Supreme Court is 54 thousand. There is talk of release of one person but not of these 54 thousand cases. Earlier, when the number of people in Pakistan was 14 crores, the number of judges was 17, while today the number is still the same.

He said, ‘A case came up recently where a person was sentenced to 25 years of life imprisonment, but the turn of this case came after 34 years. There is a huge backlog of judges, we need specialized judges. And this bill is coming under the doctrine of necessity.

On the other hand, opposition member and Pakistan Tehreek-e-Insaaf chairman Gauhar Khan said that this bill cannot be brought as a private member’s bill, it is only the government’s approval. Referring to Article 74 of the Constitution of Pakistan, he said that such a bill where the number of judges is discussed cannot be brought without the permission of the government.

Gauhar Khan gave the example of the neighboring country India and said that the population of India is one billion and 43 crores while their Supreme Court has 33 judges. ‘We have 98 judges in the High Courts. Judges in Singapore sit for 208 days while judges in Pakistan work for 155 days.

After that, Federal Minister for Law and Justice Azam Nazir Tarar said that the judiciary itself should think that when the cases have to be terminated, they should restructure.

According to a copy of the bill obtained by Independent Urdu, the Supreme Court (Number of Judges) Act, 1997 is to be amended. This Act shall be known as the Supreme Court (Number of Judges) Amendment Bill, 2024, which shall come into force forthwith. As an alternative to section two of the Act, the number of Supreme Court Judges under the Act shall be 22, excluding the Chief Justice, the maximum number of Supreme Court Judges.

The Law Minister said that the bill related to the number of judges was presented in the Senate yesterday, which has been sent to the relevant committee, postpone the bill.

It should be noted that the bill presented today in the Lower House is different from the bill presented in the Senate. In the bill presented in the Senate, the number of judges was asked to be 21.
