The speaker of the National Assembly has asked the names of the government and the opposition on the issue of formation of the judicial commission. According to the sources, the names of two members have been asked from the government and the opposition.
Four members from the Senate and the National Assembly will be appointed as members of the Judicial Commission.
It should be noted that the meeting of the Supreme Judicial Council has been called on November 8.
As per the recent changes, the Chief Justice has reconstituted the Practice and Procedure Committee and reinstated Justice Muneeb Akhtar in the three-member committee.
Former Chief Justice Qazi Faiz Isa removed Justice Muneeb Akhtar and made Justice Aminuddin Khan a part of the committee.
However, now under the Supreme Court Practice and Procedure Act 2023, the Chief Justice has been empowered to select the members of the committee.
The responsibilities of the 13-member Judicial Commission have been increased. The Judicial Commission will appoint judges in the Supreme Court, High Courts and Federal Shariat Court and monitor the performance of the High Court judges and prepare their annual performance report. .
The Judicial Commission is also empowered to suggest suitable names for High Court Judges, the same Judicial Commission will also constitute benches in the High Court and the Supreme Court.
One-third of the members of the Judicial Commission can call a meeting of the Commission, the decisions of the 13-member Commission will be taken by a simple majority of the members.
According to Clause D, the absence of any member shall not affect the validity of the decision of the Commission and despite the absence, the decision of the Commission shall be deemed valid.
The Judicial Commission of Pakistan will be a long-term commission, the role of two members of the opposition in the decision making of the commission is very key.
