The Electoral Crimes Prosecutor’s Office of the Public Ministry (MP) presented a request for the withdrawal of the right of pretrial once morest Ramiro Muñoz, head of the Citizen Registry of the Supreme Electoral Tribunal (TSE) this Thursday, March 14.
The section prosecutor, Werner Rivera, said that the request is based on the apparent omission to include the candidates of the Compromiso, Renovación y Orden (CREO) party on the electoral ballot of San Miguel Petapa in the elections of June 25, 2023.
Rivera said that the alleged omission is considered “a violation of the right to be elected.”
“Last year, on June 25, 2023, it was not published on the pink ballot for the municipal corporation election of San Miguel Petapa. There were five candidates participating for the CREO party, thus violating their right to be elected,” he declared. Rivera to the media following filing the legal action.
In a statement, the MP announced that due to this case, Muñoz is accused of the crimes of breach of duties and resolutions that violate the Political Constitution of the Republic.
As described in the statement, following having omitted the candidates from the ballot consecutively, the plenary session of magistrates decided to repeat the elections; However, following that decision, according to the investigating entity, four candidates for the municipal corporation from the CREO party resigned.
“It was established that in one of the documents presented to the TSE they forged the signature of the candidate for fourth councilor of the municipal corporation. The court was fully aware of the expert opinion carried out and that the signature was forged; however, they avoided repeating the elections,” describes the statement issued this Thursday, March 14.
The Prosecutor’s Office concludes that the request for withdrawal of immunity seeks to undertake an investigation into the case.
An attempt was made to obtain the official position of the Supreme Electoral Tribunal (TSE) regarding the legal action and the allegations made by the Prosecutor’s Office; However, until the time of writing this note, no response was received from the institution.
Regarding the case, on August 11, 2023, the then judge Gabriel Aguilera gave statements and indicated that the TSE had all the relevant documentation presented by the CREO party, including the resignations legally signed by the candidates who were going to participate in the slate. for the municipal corporation.
According to Aguilera at the time, these resignations were duly processed by the Department of Political Relations of the TSE, as part of the established protocol.
The official said that they were legally certified, and that the TSE acted in strict accordance with the law when operating said resignations and making the corresponding decision.
