The Hainaut Court of Appeal on Tuesday sentenced the mother of little Talya to a 12-month prison sentence with a five-year suspended probation for manslaughter.
On July 12, 2021, she left her eight-year-old daughter alone at home with two American Staff dogs. One of the animals had bitten the girl, who died of her injuries.
Unanimously, the court reversed the judgment of the court of first instance granting a measure of favor to the mother, namely the suspension of the pronouncement of the sentence. The condemned is now prohibited from owning dogs, regardless of race.
As for the dog confiscated by the first judgment, it will be euthanized in the event that it is recovered by the condemned. The dog is currently at the SPA of La Louvière, which opposes this euthanasia.
The mother’s lawyer spoke about the conviction and the conditions that must be met by his client. “The facts are extremely serious, so we understand the decision that was made. With these conditions, my client, if she respects them, will reintegrate and will be able to effectively move forward and rebuild herself. The conditions are in particular to pursue therapy because we are dealing with a lady who is completely devastated obviously, who lives every day with this grief and this responsibility on her shoulders. We are obviously dealing with someone who is broken and who had been depressed for already for a long time at the time of the tragedy, faced with a lady who is obviously really below everything. We can imagine her more with the loss of her daughter. So it is important for her, to consider a reconstruction, that she goes through a therapy followed with a professional, which she has already started elsewhere. She is already being followed. And therefore, therapy, finding a job, reintegrating into society. If she does not respect these conditions, obviously , the prison sentence becomes effective so it’s a little bit, I would say, a sword of Damocles.”
