The Economic Misdemeanor Court attributed the tightening of the sentence once morest Counselor Mortada Mansour to 3 months in prison for accusing him of insulting Al-Khatib, due to his previous conviction for insulting the complainant and the issuance of a one-month prison sentence (he served his sentence).
And the court, headed by Counselor Ibrahim Salih, deposited the reasons for its ruling to punish Mortada Mansour, the dismissed president of Zamalek Club, with 3 months in prison, a fine of 20,000 pounds, a bail to suspend execution of 10,000 pounds, and 10,000 pounds as a temporary civil compensation for insulting and slandering “Al-Khatib.”
The court relied in its ruling on the fact that the prosecution emptied the storage unit presented by Mahmoud Al-Khatib’s defense, and the report of broadcast engineering experts at the National Media Authority indicated that the recorded material proceeded normally without deletion or addition.
The court added that it was satisfied with the plausible evidence that it had seen, that the accused slandered the victim publicly through one of the means of communication, as he attributed matters that, if true, would have necessitated contempt for his countrymen and punished him legally, and deliberately disturbed and insulted him publicly through a telephone intervention to a television program.
The court said that it was satisfied with punishing Mortada Mansour for the crime of intentionally disturbing, as it is the most severe crime stipulated in Article 76/2 of Law 10 of 2003, which stipulates that “without prejudice to the right to appropriate compensation, he shall be punished with imprisonment and a fine of not less than 500 pounds and not exceeding 20 thousand.” 1 pound or one of these two penalties for anyone who deliberately disturbs or annoys others by misusing telecommunications equipment.
She indicated that the punishment came for the precedent of the accused committing a similar crime in Case No. 83 of 2022 Economic Misdemeanor and its appeal, and it included insulting the complainant once morest him once morest the same complainant, and a one-month prison sentence was issued once morest him, which requires severe punishment.
The prosecution referred Mortada Mansour to trial because, on August 18, 2022, in the Agouza Department, he publicly slandered the victim, Mahmoud Ibrahim Ibrahim Al-Khatib, by assigning to him matters that, if true, would have necessitated his contempt for his countrymen and punish him legally, during a telephone intervention to the “Zamalkawi” program broadcast on the channel. Zamalek, which is available to all to view, as well as the video clip published on the Zamalek channel on the social networking site YouTube.
It also attributed to him that he publicly insulted the complainant, by addressing him with insulting words and phrases to his honor and consideration through the same telephone intervention to the program, and he also deliberately disturbed and harassed the victim by misusing communications equipment by committing the two crimes under the previous two accusations.
It is noteworthy that the Appellate Economic Court set the next August 10 session to consider Mortada Mansour’s appeal once morest his one-month imprisonment.
Mortada Mansour had served a one-month sentence in Wadi al-Natrun prison following being convicted by the Court of Cassation of insulting and slandering Mahmoud al-Khatib.
