Montreal Real Estate Broker Fined $150,000 for Conflict of Interest: Find out the shocking details

A Montreal real estate broker with 38 years of experience will have to pay a $150,000 fine and will be suspended for 180 days for placing herself in a serious conflict of interest situation on three occasions.

“Among the aggravating factors, the at-fault broker made a profit of more than $500,000 at the expense of vulnerable people who suffered significant financial harm,” reveals a decision rendered a week ago by the Disciplinary Committee of the Self-regulatory organization of real estate brokerage of Quebec (OACIQ).

Brigitte Le Pailleur, manager of the real estate agency “Le Pailleur” in Le Plateau-Mont-Royal, was found guilty of three counts and will therefore have to pay the maximum penalty of $50,000 for each of them.

In summary, in 2018 she tried to buy a triplex directly from sellers who had entrusted her with its sale through a brokerage contract.

“Ms. Le Pailleur was carrying out her real estate brokerage activities, she immediately smelled a good deal as well as the vulnerability of her clients. What followed was a series of continuous and premeditated offenses,” the legal document reads.

A good lesson

Among the alleged facts, the 71-year-old broker obtained “strategic information from sellers” and did not market a property on Centris “in violation of her brokerage contract.”

“Subsequently, while her brokerage contract was still in force, she made a verbal purchase offer to her clients while directly negotiating the terms and conditions of the sale with them,” deplores the Disciplinary Committee. .

Finally, Brigitte Le Pailleur was convicted because she did not objectively advise her clients so that they might be represented by a real estate broker of their choice.

“We are satisfied with the decision, because it truly embodies our desire to protect the public, in addition to sending a dissuasive message to real estate brokers who ignore the ban on placing themselves in a conflict of interest situation, which has been repeated many times and sanctioned by the courts,” commented Me Caroline Champagne, Vice-President Supervision, of the OACIQ.

The Disciplinary Committee also recognized that the septuagenarian was at risk of repeating these “dishonest gestures” in the future.
