Mobile phone providers have to pay back the service fee | Nachrichten.at

One case is already legally binding, the appeal period is still running in the others, reported “Kurier” and “Tiroler Tageszeitung” in their Monday editions. In more than 250 cases, the mobile phone operators A1, Magenta and Drei averted judgments by paying back the flat rate, said Viennese lawyer Matthias Strohmayer, trusted lawyer for the Association for Consumer Information. Strohmayer is in charge of over 1,000 cases, wrote the “Tiroler Tageszeitung”.

But the Chamber of Labor also filed a collective action in January this year once morest the mobile phone operators’ service fees. The verdicts are still pending here.

Most mobile phone providers charge a service fee once a year. They introduced this in 2011. After the Supreme Court overturned a similar levy on fitness centers around a year and a half ago, the discussion regarding flat-rate service fees for mobile communications flared up once more.
