MK Highlights the Number of Votes Shifting for Political Parties in the 2024 Legislative Election Dispute Session

The Constitutional Justice highlighted the large number of vote transfers between political parties (political parties) in the 2024 Legislative Election (Pileg). This was explained in the trial of the dispute over the results of the 2024 Pileg general election (PHPU), Monday (29/4) at the Constitutional Court (MK) Building, Jakarta, Monday (29/4).

At the hearing at Panel 2 which adjudicated disputes in the East Java electoral district, Constitutional Justice Saldi Isra highlighted the large number of vote shifts following hearing the arguments presented by the applicant.

“The KPU (General Election Commission) also has a responsibility to explain the many stories of vote transfer,” said Saldi, who is the Chair of Panel 1 which consists of Constitutional Justices Arsul Sani and Ridwan Mansur.

In case Number 102-01-05-15/PHPU.DPR-DPRD-XXII/2024, for example, the NasDem Party is petitioning. Based on the party’s internal vote count in electoral district (dapil) East Java (Jatim) 8, the NasDem Party should have received 327,271 votes. However, from internal party investigations, NasDem’s votes actually moved to the Indonesian Democratic Party of Struggle (PDIP).

From the recapitulation results, KPUnasDem only got 326,578 votes or 693 votes less. On the other hand, PDIP, from NasDem’s internal count, received 327,259 votes. This is different from the KPU recapitulation results which achieved 327,921 votes.

The results of the search occurred at a number of voting stations (TPS), namely Mojokerto Regency, Madiun Regency, Mojokerto City, Madiun City, Jombang Regency and Nganjuk Regency.

“There was a deliberate error by the respondent (KPU) which resulted in doubt regarding the vote results in the East Java electoral district 8 because there were so many differences in the results between model C results and D results from sub-districts in the districts/cities,” said the attorney for the NasDem Party, Reginaldo Sultan.

According to him, there was an inflating of PDIP votes which resulted in a reduction in votes for NasDem. This, he said, raised suspicions that there was an element of deliberate intent to win over certain political parties. Reginaldo also said that as a result of the vote transfer, NasDem felt disadvantaged because it lost one DPR seat in the East Java 8 electoral district which should have received two seats.

“Because the defendant himself did this, the principles of structured, systematic and massive fraud actually occurred in the 2024 election,” he said.

In case Number 46-01-17-16/PHPU.DPR-DPRD-XXII/2024 filed by the United Development Party (PPP), it is also alleged that there was a transfer of votes between political parties. In the trial chaired by Panel Chair Judge Suhartoyo at Panel 1, PPP attorney Dharma Rozali Azhar said there were differences in internal vote counting in the Banten I, Banten II and Banten III electoral districts.

Dharma explained that there was a shift in PPP votes to the Garuda Party of 5,000 votes in the Banten I electoral district, then 5,450 votes in Banten II and 8,150 votes in Banten III. According to him, this occurred due to a calculation error by the KPU.
So, he said, the Garuda Party’s vote share, which was originally 131 votes in the Banten I electoral district, increased to 5,131 votes. Then in Banten II, initially 104 votes increased to 5,554 votes and by 103 votes in Banten III it increased to 8,253 votes.

“On that basis, there are enough grounds and legal reasons for the Court to grant the applicant’s application and determine the correct vote acquisition according to the applicant’s version,” he explained.

The 2024 Legislative Election dispute hearing begins with a preliminary hearing, namely hearing the main points of the petition. It was held for four days, starting today, Monday (29/4). The Constitutional Court has registered 297 PHPU cases for the 2024 Legislative Election for the DPR, DPD, Provincial DPRD and Regency/City DPRD elections. The Constitutional Court has also accepted the Relevant Party’s application on April 23-24 2024.

The political parties that filed the most cases were the Gerindra Party and the Democratic Party, namely 32 cases each. Then, based on province, Central Papua is the province with the most PHPU 2024 Legislative Election cases filed, namely 26 cases. (Z-11)
