Current law stipulates that when a North Korean citizen owns property in South Korea through inheritance or bequest, a property manager is appointed and the manager must obtain permission from the Minister of Justice to dispose of the property.
Regarding this, despite the fact that the actual use of the property of North Korean residents is slim, in the case of financial properties such as deposits, they can be withdrawn without permission from the Minister of Justice under the pretext of preservation (building repair, etc.). comments have been raised. Recently, inherited property owned by North Koreans in South Korea has also surged from 6 billion won in 2012 to 46 billion won as of December last year, increasing the need for protection.
Under the current law, the Ministry of Justice added cases where a property manager conducts ‘financial transactions exceeding the amount prescribed by the Presidential Decree’ as subject to permission by the Minister of Justice. In addition, a safety device has been established that requires property managers to submit permission from the Minister of Justice to financial institutions when withdrawing deposits from North Korean residents.
An official from the Ministry of Justice said, “During the legislative notice period, we will fully collect various opinions from the public to finalize the amendment bill and make efforts to quickly pass the amendment bill through the National Assembly.”
