MEMBER of Commission VII of the Indonesian House of Representatives, Mulyanto, assessed that the acceptance of mining concessions for Muhammadiyah would be very vulnerable and would cause trouble for concession recipients. According to him, Government Regulation (PP) Number 25 of 2024 concerning the Implementation of Mineral and Coal Mining Business Activities which is the legal basis for granting priority for mining concessions was subject to Judicial Review (JR) and was canceled by the Supreme Court. “Muhammadiyah is in trouble. PP Number 25 of 2024 concerning the Implementation of Mineral and Coal Mining Business Activities is in conflict with Law Number 3 of 2020 concerning Mineral and Coal Mining,” said Mulyanto, Monday (29/7).

Specifically related to the article regulating the provision of priority for the offering of Special Mining Business Permit Areas (WIUPK) which are former PKP2B areas to Business Entities owned by religious community organizations.

In the Minerba Law, priority is given to BUMD/BUMD. Article 75 Paragraph (3) and (4) of the Minerba Law clearly and firmly stipulates that the priority for granting WIUPK is to BUMN/BUMD. Meanwhile, for private business entities, the granting of WIUPK is carried out through a fair auction process.

“Actually, the government’s good intention to help religious community organizations would be safer from a regulatory perspective if it were done through the provision of participating interests (PI) or assistance through CSR funds for mining sector businesses, not through the provision of mining concessions,” he stressed.

He also regretted the decision of PP Muhammadiyah which finally accepted the offer of mining management from the Government. Mulyanto was worried that this decision would hurt the public’s hopes for Muhammadiyah’s independence and independence before the government. (Iam/Z-7)
