Minimum wages lower than the Smic in more than half of the professional branches

The Ministry of Labor indicated that in France, at the end of August, 80 of the 171 professional branches concerning more than 5,000 employees were operating with salary grid levels below the minimum wage. The increases in the minimum wage in 2021, 2022 and 2023 to offset the effects of inflation have led several sectors to offer salaries that have become non-compliant.

The last increase, which took place on May 1, brought to 147 the number of branches in which at least one salary grid contains remuneration below the minimum wage. The ministry assured that the figure had since been reduced to 80. For example, two branches have remained in a situation of non-compliance since 2021 and 13 for more than a year.

An upcoming “social conference” on the subject

Employees whose minimum wage is lower than the minimum wage are not necessarily paid less than the Smic, however. It is up to their employer to make up the difference. Faced with such a situation, Emmanuel Macron called on Wednesday for the organization of a “social conference” on “careers and branches below the minimum wage”.

The phenomenon indeed favors a “gradation of the grid”, which sees several levels of seniority not being paid above the minimum wage, leading to an increased concentration of employees around the minimum wage. Professional branches have a legal obligation to periodically negotiate employee pay scales on salaries. On the other hand, they are not required to reach agreements.
