Millionaire lawsuit against the municipality of Cinco Saltos for a breach in the payment of rents

A rental debt from the municipality of Cinco Saltos triggered a civil lawsuit for 1.5 million pesos plus interest. Diego Ojeda and Gabriel Lagos filed an administrative dispute following exhausting the administrative instance for an alleged breach of contract with the Executive Branch of the Valletana commune. Mayor Liliana Alvarado assured that they are regularizing the delay in payments.

The case fell to the Civil Chamber of Cipolletti because the Contentious Administrative jurisdiction in the Fourth District of the Judiciary of Río Negro is not yet working. Civil Court No. 3 declared itself incompetent to resolve and for this reason it will be analyzed by the Chamber.

The case was filed on June 1, as explained by the plaintiffs, following the administrative instances were exhausted without reaching an agreement.

Ojeda and Lagos filed a contentious administrative lawsuit once morest the Municipality of Cinco Saltos on November 11, 2021, “in order to obtain the executive collection of the sum of $1,520,000 plus interest”derived from the lack of payment compliance by the Municipality.

The presentation was made in the Civil Court that resolved on March 7 of last year its incompetence in the claim.

In February of this year, the request was raised once more and “having expired the relevant deadlines” they requested a prompt dispatch on May 28, 2023. Given the lack of response from the Executive, on June 1 they advanced with the civil case. From the Executive they assured that they are working on the issue to resolve the conflict.

“After analyzing the new records submitted to the case, it is noted that on February 7, 2022 the plaintiffs once more filed the administrative claim with the Municipality of Cinco Saltos and, finally, On April 28, they requested the request for prompt dispatch.without to date -according to they allege- they have obtained a response from the defendant”, maintains the resolution of the Chamber that enabled the contentious process but asked the plaintiffs to adjust the claim as “executive demand for rents”.

The resolution is dated July 7 and gives the advisers from Ojeda and Lagos 10 days to adjust the request.
