This followingnoon, in the evening edition of the Official Gazette of the Federation (DOF), the federal president launched a new decree, with the signatures of the Secretaries of the Interior, National Defense and the Navy.
“The construction, operation, maintenance, operation, infrastructure, spaces, goods of public interest, execution and administration of the transport infrastructure, services and development poles for the well-being and equipment of both the Mayan Train as well as the Interoceanic Corridor of the Isthmus of Tehuantepec, and the airports of Palenque, Chiapas; of Chetumal and of Tulum, Quintana Roo, in the terms expressed in the considering part of this decree”, it refers.
The immediate publication of this decree, hours following the Court’s ruling, would seek to prevent the INAI from denouncing that the executive made a repetition of the act annulled in the controversy.

“INAI is analyzing legal mechanisms to defend transparency and the right of access to information on works and infrastructure projects of the federal government, before a new Executive Decree,” he said.
Today’s decree no longer orders expediting procedures for priority works in general, as it did in 2021, but it does repeat the national security classification that the Court rejected today, for affecting access to information.
All the works included in today’s decree are in charge of the National Defense and Navy secretariats, whose owners also endorsed the document with their signature.
In the document, the president warns that, due to their geographical location, proximity and connectivity, the five works are complementary to maintain the internal and national security of the country.
“Due to the nature of its facilities, it is appropriate to recognize the nature of strategic and priority and, therefore, of public interest and national security,” he published.
López Obrador refers that, on July 11, 2022 and May 3 of this year, the National Security Council declared the Mayan Train and the Interoceanic Corridor as of “national security and public interest” “due to the objectives they pursue , its strategic location in the national territory and the nature of the provision of its services”.
The decree details that the classification contemplates the construction, operation, maintenance, operation, infrastructure, spaces, goods of public interest, execution and administration of transport infrastructure, services, development poles for well-being and equipment.
In the case of the Mayan Train, its route through the states of Chiapas, Tabasco, Campeche, Yucatán and Quintana Roo is described.
For the Interoceanic Corridor of the Isthmus of Tehuantepec, its area of influence in Chiapas, Oaxaca, Veracruz and Tabasco, as it goes from the Port of Chiapas to Salina Cruz, Coatzacoalcos and Dos Bocas and includes railway lines K, Z, branch ZA, FA and branch Two Mouths to Roberto Ayala.
