The Superintendency of Social Security (Suseso) instructed the Preventive Medicine and Disability Commissions (Compín) and the isapres that it is not appropriate to reject medical licenses that might be submitted following the deadline by workers in areas declared in a state of constitutional exception of catastrophe, as is happening in the provinces of Marga Marga and Valparaíso, due to the fires of recent days.
In Circular No. 3804, dated February 5, 2024, the regulator also indicated that sanctions will not apply, in the case of employers, for delays in processing medical licenses.
It should be remembered that dependent workers must present the medical leave to the employer within two or three business days depending on whether they are workers in the private or public sector, respectively, counted from the business day following the date of the start of the medical leave. Independent workers, for their part, must present the license within two business days following the start date of the rest.
In the event that paper medical licenses have been destroyed due to fires, replacement medical licenses will be issued.
Medical care from mutual societies
In addition, the supervisory body instructed the employer mutual societies (ACHS, IST, MUSEG) and ISL to provide medical and/or psychological care in person or via telematics for the affected workers both in the care centers and in their respective homes if so. was necessary
