Is sick leave for miscarriage without a waiting day, fake good news? Since January 1, a woman who has a miscarriage can benefit from sick leave without a period during which she receives no compensation. But there is a catch: Health Insurance specifies on its site that the doctor who prescribes stopping must use “a specific paper form”, spotted The Parisian. Enough to make the employer understand the reason for the stoppage, since the natural termination of pregnancy is the only reason which allows, in the event of work stoppage, not to have a day without pay.

During the debates in the National Assembly, François Braun, then Minister of Health, nevertheless assured that “sick leave allows[trait] to guarantee confidentiality”, particularly with regard to the employer. Enough to make several activists rebel, including Judith Aquien, member of the collective False couche, true experience. According to her, “the Health Insurance addendum endangers medical secrecy and confidentiality”. “Women are thrown out to pasture to their employers, in a society which already discriminates greatly once morest those who become mothers,” she believes in the article in the Parisian. The daily recalls that in France 15 to 20% of pregnancies result in miscarriages.
An “incomplete and inaccessible” right
On its website, Health Insurance explains that “if you wish to prevent your employer from having indirect knowledge of the medical reason for your leave, you can ask your practitioner to prescribe sick leave for you under the conditions of common law. He will then be compensated with application of the waiting period.” A way to get around the problem? For Judith Aquien, this right which came into force at the start of the year is therefore “incomplete and inaccessible”.
