The law introduces regulations for general AI (GPAI) or Basic models such as GPT-4, Gemini, Llama or Bloom as well as large AI models that use transfer learning. An important subcategory of GPAI that will have a significant impact are those with a so-called systemic riskThe law sets out criteria to classify GPAI with Systemic risks to identify, as well as for the additional compliance effort. While many of the criteria are clear, some could lead to debate. By treating systemic risk GPAIs separately, the law reduces the compliance effort for other models – thus striking a balance between risk management and innovation. Companies that use models with a systemic risk must meet certain requirements and obtain approval from the EU AI authorities. Compliance is less strict, especially for open source base models.
Compliance is a top priority
Dealing with the EU AI law is a major challenge for companies – also due to the complex compliance requirements that they have to decipher. This includes, for example, control after the AI model has gone live. This increases the operational burden. But it gives users and authorities a positive feeling when using the systems.
