In a few days, the legal fight between the Apple it’s at Fields involving the Apple Watch’s blood oxygen monitoring feature will celebrate its fourth anniversary — precisely at one of the busiest moments in this imbroglio.
So far, this dispute has caused a lot of headaches for the Cupertino giant, which has seen sales of its watches paused in the United States due to accusations from the company led by the CEO. Joe Kiani — decision that, as we mentioned here, has already been reversed by the American courts (even if temporarily).
This apparent success of Masimo in this case, however, did not come for nothing. In an interview published by Wall Street Journal not last Saturday (12/30)Kiani said his company has already spent approximately US$100 million in this fight once morest Maçã — which, by all indications, is far from over.
Kiani also shared with the vehicle that he was warned by his employees and friends regarding the risks of embarking on a legal fight with Apple, one of the richest and most powerful companies in the world. The CEO, however, defended his intention to challenge her:
Nobody is facing them. If I can do it, it might change Apple for the better.
This, it is worth noting, is not the first time that Masimo has embarked on a legal crusade once morest a company. In 2006, the company won a seven-year-long dispute once morest Nellcor, which at the time was the main supplier of a rival oximeter. According to WSJthe company led by Kiani had revenues of US$800 million at the time with compensation and payment of royalties.
Another brand that also had to clash with Masimo was the famous Royal Philips — better known simply as Philips. Closed in 2016, this case ended with the Dutch giant agreeing to pay US$300 million to Kiani’s company and to use the company’s technology in its products. This movement generated, in total, more than US$1 billion for Masimo.
In fact, this is not even the first time that the company has sued a wearable device manufacturer over its blood oxygen monitoring technology. As remembered by The Vergein December 2022, Masimo won a fight once morest True Wearables — a company founded by the Brazilian Marcelo Lamegowhich, as we mentioned, also has a hand in this fight with Apple — under very similar circumstances.
Kiani, it is worth noting, has already said he is willing to enter into an agreement with Maçã, although the company has not made any moves towards this. According to him, his dispute once morest the iPhone manufacturer might have a positive impact on other smaller companies:
I feel like I have to do this. If I can stop the most powerful company in the world from continuing to do bad things, that will have more of an impact on the world than anything else I’m doing.
