According to the information obtained by the site, the prosecution of the accused commissioner in this case, which took place when the latter was acting head of the local judicial police unit at the security commission in Imintanout, was based on a report submitted by the King’s Attorney at the Court of First Instance in Imintanout, No. 53/2017, to the King’s Attorney General in Marrakech regarding the theoretical beating of a guard named “Mohamed, A. M.”, who works as a day laborer and is the sole breadwinner for his mother, and hails from the Ait Faska community in the Al Haouz province. He stated during his appearance before the Public Prosecution, on a fabricated theft charge on April 15, 2017, that he was subjected to violence and beatings during his preliminary hearing at the police station, which was witnessed by the Deputy King’s Attorney during the appearance of the detainee.

Accordingly, the same data adds that the Attorney General at the Court of Appeal in Marrakech opened an investigation into the incident in light of the report of the Public Prosecution Office at the Imintanout Primary Court, where the complainant was heard on June 6, 2017, and stated that he was beaten by this police chief in Imintanout and his assistants inside the police station when he was heard as an unjustly accused person by the manager of a warehouse for manufacturing and selling building materials, for theft on April 13, 2017, confirming that the police chief threatened him with an electric stick and threatened him with rape if he did not confess to the charge once morest him, before slapping him twice in the face and leaving him to the two police officers who beat him, which led to his injury to his left eye and face, which was confirmed by a number of witnesses who stated before the Public Prosecution Office that the complainant was healthy when he entered the police station.

After the investigation with the police chief ended on September 30, 2021, the Attorney General at the Court of Appeal in Marrakech decided to refer the file to the investigating judge at the same court, requesting that he investigate the charges once morest him and refer him and the case file to the court’s initial criminal chamber in accordance with the law.

This, and the Court of Cassation in Rabat had previously decided to uphold an appeal ruling ordering the aforementioned police chief to be stripped of his judicial police duties, through the operative part of a special ruling in misdemeanor cassation case No. 11052/6/2033, following the Misdemeanor Cases Division of the Court of Appeal in Marrakech had previously decided (in the same case) in its session on Wednesday, April 26, 2023, to issue a ruling ordering the same police chief to be held accountable for the violations and professional irregularities attributed to him, and to permanently strip him of his judicial police duties and charge him with the costs. This is as a result of his prosecution for the felony of forgery, bribery and threat in a sensational case whose trial sessions are still ongoing once morest this chief.
