Excerpts from the report of the Francophonie observation mission which was in Madagascar from November 27 to December 7, 2006
The mission noted:
– the plethoric number of voters in certain polling stations (often going beyond 3,000) has put into perspective the fluidity of traffic and favored the extension of the time of electoral operations;
– the relatively high and significant number of voter cards not distributed;
– the absence of control of the state of the fingers of voters on their arrival was obvious in certain polling stations;
The Mission noted a disparity in the competence of electoral staff. She noted that in the polling stations located in town, the latter was aware of his duties and endeavored to respect them. This was not always the case in polling stations in rural areas.
The members of the mission also noted that, with the exception of the delegates of candidate Ravalomanana who were present in all the polling stations visited, the presence of the delegates representing the other candidates was very limited, even reduced; their number varying according to the polling stations.
The members of the mission also checked the presence of national observers, mainly those from the CNOE working in a significant number of polling stations.
It should be noted that in the polling stations visited, the members of the mission noted that ballot papers for all candidates were not made available to voters. In fact, pursuant to electoral legislation (Article 47 of the Electoral Code) which makes each candidate responsible for printing their own ballot papers, seven candidates (Manadafy Rakotonirina, Monja Roindefo, Elia Ravelomanantsoa, Ferdinand Razakarimanana , Philippe Tsiranana, Daniel Rajakoba and Jules Randrianjohary), were unable to deposit all the ballot papers required at the end of the precise timetable established by decree n°2006-672 of September 12, 2006, organizing the deposit of these ballot papers . The ballot papers deposited by the candidates within the legal deadline were distributed by the administration to the polling stations indicated by the candidates themselves to be the recipients.
Consequently, the unavailability of all the ballot papers in the polling stations characterized the election of December 3. In almost all of the 17,581 polling stations, the ballots of candidates Daniel Rajakoba, Ferdinand Razakarimanana, Monja Roindefo and Philippe Tsiranana were not available. Eight to ten ballots out of the fourteen candidates were on average present in the polling stationsthereby creating significant distortions in the conduct of the ballot.
Faced with this situation, and in order to avoid any incident resulting from the absence of all the ballot papers in the polling centers, the Ministry of the Interior, on the eve of the election, gave instructions to the presidents of polling stations to collect the ballot papers that would be provided by the agents of the candidates at the polling stations on the day of the election; not to make them available to voters in the polling station, but to count them as valid during the counting if they were deposited in the ballot boxes. This measure, which might have been the source of confusion, has however only been applied marginally.
The Francophone mission noted:
– The many shortcomings in the electoral lists in terms of material errors and omissions which, due to hasty computerization, might not be established according to the chosen protocol. This situation has maintained, within public opinion, doubt and discredit on the reality of the electoral lists.;
The French-speaking mission verified that despite the desire repeatedly emphasized by the political authorities to confer effective independence on the institutions involved in the organization of the ballot, the reality of this is not always perceived as such by good number of political actors and by public opinion.
It should be noted that the full participation of the electorate in the December 3 election suffered from shortcomings related to the establishment of electoral lists as well as difficulties observed in the distribution of voters’ cards. This situation is evidenced by the relatively high and significant number of undistributed voter cards, which remained at the polling stations, leading, de facto, to the exclusion of part of the electorate from participating in the ballot..
It is certainly this parameter aimed at observing the holding of free, reliable and transparent elections as prescribed by the Bamako Declaration that the Mission was able to identify the greatest number of unsatisfactory points. Indeed, from the pre-election phase, the requirements of equal treatment in terms of eligibility conditions were mentioned by some candidates whose application was rejected by the High Constitutional Court. During the election campaign, of course the airtime allocated by the National Electoral Council to the various candidates on the public audiovisual media was respected; however, an imbalance in the fair treatment of candidate news by the public audiovisual media, both in terms of the airtime granted and concerning the editorial surface selected for the candidate Ravalomananaviolating the pluralism and balance of information in the public media, was noted.
The break in the equal treatment of candidates has above all been verified through the temporary authorization, by way of experimentation, granted to the radio and television of the Malagasy Broadcasting System (MBS), channels belonging to the Tiko group belonging to the candidate Ravalomanana, for national satellite broadcasts.
