The Regional Election Law stipulates that manipulation of support for individual candidates to advance in regional head elections can be subject to criminal sanctions.
Article 185 of Law No. 8 of 2015 states that anyone who intentionally provides false information or uses a false identity to support an individual candidate pair to become a gubernatorial candidate and a vice gubernatorial candidate, a regent candidate and a vice regent candidate can be sentenced to a minimum of 12 years and a maximum of 36 months in prison.
In addition, those who are proven to have manipulated support data and personal identity will also be subject to a fine of at least IDR 12 million and at most IDR 36 million.
Election expert Titi Anggraini condemned the alleged personal data theft by Dharma Pongrekun and Kun Wardana. She hopes that people who feel disadvantaged because their data has been stolen without their knowledge can report it to Bawaslu in their respective regions.
“So for the public who find their data being used by candidate pairs and not factually verified in the nomination process, it is hoped that they can report this to the nearest Bawaslu area. It is better to report directly to the Provincial Bawaslu for gubernatorial nominations and the Regency/City Bawaslu for regent/mayor nominations in their area,” said Titi to Media Indonesia, Friday (16/8).
In addition, Titi hopes that Bawaslu according to its level is also expected to be proactive. There is no need to wait for reports to be received to process any indications or findings of alleged misappropriation of individual candidate support requirements.
Previously, Head of Technical Division of KPU DKI Jakarta Dody Wijaya dismissed the accusation that the nomination of Dharma Ponrekun and Kun Wardana was part of an empty box scenario. He said that KPU DKI Jakarta had worked in accordance with existing procedures and rules.
“The KPU cannot regulate whether or not it passes. But this is all a factual verification process in the field with close supervision by Bawaslu friends and there are also monitoring friends, then the recapitulation is carried out in stages from the sub-district level, district-city level and today ends at the provincial level,” he explained, Thursday (15/8).
