Man was investigated by the police in secret – lawyers believe he is entitled to compensation

Attorney John Christian Elden speaks VG that individuals who have been subjected to unreasonable or erroneous investigations, including the use of undercover agents and extensive surveillance, may have grounds to seek compensation.

– This is particularly relevant if the investigation has been going on for a long period of time and has caused significant psychological stress or damage, he tells the newspaper.

VG wrote last week about Aslak, who for nine years has been suspected of a murder in Ørje from 2000. Without making the 79-year-old aware of the suspicion, an undercover police agent moved into a dormitory in his house for eight months in 2015 to to investigate the case.

Aslak never admitted to any murder, and he received no explanation from the police in the years that passed as to why he was a murder suspect. It was not until April this year that the investigation was dropped.

Elden estimates that the compensation claim in a case like Aslak’s can be between NOK 100,000 and 200,000, depending on the circumstances and the documented burden.

Also the leader of the Forsvarergruppen, lawyer Mette Yvonne Larsen, former leader of the Forsvarergruppen, lawyer Marius Dietrichson and lawyer Maria Hessen Jacobsen all say that Aslak is entitled to compensation.

Hanne Skallerud, section chief in the Norwegian Police Directorate (POD), says they must decide on a claim when they receive it.
