Man Set on Fire Outside Ma On Shan MTR Station: Conviction and Controversy Surrounding Disturbing Disorder Case

In November 2019, a man was doused with flammable liquid outside the Ma On Shan MTR station and set himself on fire and was injured. A 37-year-old and a 43-year-old couple at the scene accused the man of abusive language and were charged with public disturbance After ordering, he was acquitted of the crime. After an appeal by the Department of Justice, the Eastern District Court ruled yesterday that he was guilty of disturbing order and sentenced to 5 weeks in prison.

In his ruling, the judge pointed out that the noisy behavior of the two people was “fueling the fire”, and believed that the prosecution had proved beyond reasonable doubt that the behavior involved in the case was likely to cause the people present to use or threaten to use force once morest others, which would have a negative impact on social peace. The actual and imminent risk, so the two were convicted instead.

Ge Peifan, a member of the Legislative Council who assisted the injured Li Bo, pointed out that although the couple involved were not the ones who started the fire, their booing at the scene heated up the dispute.
