Major Breakthrough in the Case of Omar Harfouche and Najib Mikati: International Dimensions and UN Human Rights Involvement

After a long period of persecution to which Omar Harfouche, the initiator of the Third Republic of Lebanon, was subjected, the first sparks of truth rose in the case of caretaker Prime Minister Najib Mikati and Harfouche, a case that took on an international dimension and even reached within the United Nations Human Rights Organization.

After the Harfouche case was raised during the 54th regular session of the United Nations Human Rights Council and following the session issued recommendations to support and protect Harfouche in the face of attempts to harm him by the Lebanese system, the awaited judicial decision was issued by the indictment panel headed by Judge Sania Al-Sabaa.

According to the data, as a result of the legal follow-up of the judicial dispute between Mikati and Harfush, and following the issuance of the indictment decision by the first investigating judge in the north, Samaranda Nassar Al-Zalem, to refer the file to the indictment body for crimes with a criminal description that ignore the simplest legal rules, the indictment body in the north issued a decision today. Presided over by the first president, Judge Sunia Al-Sabaa, she issued a decision in which she declared that the judicial judiciary had no jurisdiction to continue examining the case referred to by Harfouche, following he took on the indictment decision issued by the first investigating judge in the north, Samaranda Nassar, for violating the law and failing to implement the peremptory and binding legal texts and rules.

The Public Prosecutor of Appeal in the North, Judge Ziad Al-Shaarani, had previously approved the request of Harfouche’s representatives, lawyers Jalal Aoun and Joseph Raphael, to request the recovery of the arrest warrant in absentia that was issued by the first investigating judge once morest Harfouche.

It is expected later that legal procedures will be followed up to complete the issuance of a final decision refuting all charges once morest Harfouche. It is assumed that Judge Al-Sabaa will determine the competent authority that will follow up on the case to reach its conclusion, and Al-Sabaa, which dealt with the file with complete transparency, will sign a request to retrieve the arrest warrant once morest Harfouche, similar to the decision of Public Prosecutor Ziad Al-Shaarani.
