The Fair Trade Commission held the 4th Agency Agreement Evaluation Committee on the 12th of last month to deliberate and confirm the ‘2021 Agency Agreement Evaluation Results’ and announced on the 7th that it would provide incentives to companies with excellent evaluations.
As a result of the evaluation, among the 10 companies subject to evaluation, the highest grade was Maeil Dairy, the excellent grade was CJ CheilJedang, and the good grade was E-Land World, Orion, and Namyang Dairy.
According to the Fair Trade Commission, Maeil Dairies established the fairness of the contract by establishing and complying with detailed standards and procedures for the amount received and paid by the agency as well as the contract termination as internal regulations.
In addition, CJ CheilJedang operated a win-win support program such as 50% of the purchase cost of refrigerators (2.36 billion won), college tuition for the children of agency employees (130 million won), and emergency support for the number of elements (3 million won).
The agency agreement was introduced to support the voluntary compliance of suppliers and agencies with fair trade laws and win-win cooperation.
The evaluation of agency agreements was conducted for the first time for 8 companies in 2021, and for the second time this year for 10 companies.
Evaluation factors consist of ▲Fairness of contract ▲Efforts to prevent and comply with laws ▲Support for win-win cooperation ▲Deduction for violations of law ▲Satisfaction with agency, etc. The result will be decided through deliberation.
The evaluation results are divided into three grades: best, excellent, and good, and incentives are provided to companies with excellent evaluation.
Specifically, the best (95 points or more) company is exempted from the ex officio investigation for two years, and a commendation from the chairperson for corporations and individuals is awarded. Excellent (90 points or more) companies are exempted from the ex officio investigation for one year, and corporations are awarded a commendation, and good (85 points or more) companies are awarded a corporate chairman’s commendation.
According to the Fair Trade Commission, matters for a fair contract, such as clearly preparing and complying with the internal regulations for details on the calculation criteria and payment procedures for the amount received and payment by the agency, and the method of objecting to the termination of the contract, which are the most important for the fairness of agency transactions There were a total of 4 companies that systematically established
In addition, among the companies subject to evaluation, the number of companies that fully introduced and used standard agency contracts increased from the previous year (2) to 4 companies.
In addition, 7 companies were establishing and operating computerized systems for the issuance of documents such as contracts and confirmation of order details, and it was found that all 10 companies installed and operated departments in charge of fair trade promotion (personnel appointments, etc.) .
In addition, each company that provided a total of KRW 3.8 billion in loans (a total of KRW 3.8 billion) through a fund jointly created with a financial institution such as a bank and provided direct support for a total of KRW 2 billion for the labor costs of salespersons at agencies, etc. 4 confirmed.
Through this, 7 companies provided a total of 130.4 billion won in support for promotions, logistics supplies, and online sales.
In addition, in the case of nine companies, a total of 2.1 billion won was provided, including quarantine supplies to overcome the COVID-19 crisis, work clothes for agency employees, and expenses for congratulations and condolences.
By operating and evaluating the fair trade agreement system in the agency field, the Fair Trade Commission expects that fair trade and win-win cooperation in the agency field will be enhanced, such as the expansion of the agreement system and the increase in the signing of agreements between suppliers and agencies in various industries.
Meanwhile, the Fair Trade Commission is planning to hold a briefing session within this year to encourage the signing of the agreement for suppliers participating in the survey on the actual condition of the agency transaction in order to vitalize the agency agreement.
In addition, we plan to actively publicize the best practices of win-win cooperation by excellent evaluation companies at the fair trade agreement implementation best practice presentation and include them in the best practice book.
