THE Supreme Court (MA) has revealed the reasons why it has not responded to the recommendation of the Judicial Commission (KY) to bring the panel of judges at the Surabaya District Court (PN), which acquitted Ronald Tannur, to the hearing of the Judges’ Ethics Council (MKH) to be dismissed.
Ronald Tannur is the son of former PKB Faction member of the DPR, Edward Tannur, who was a defendant in a case of alleged assault on his girlfriend, Dini Sera Afriyanti, which resulted in the victim’s death.
Supreme Court spokesman Suharto said that he could not yet make a MKH regarding the report on alleged ethical violations by three Surabaya District Court Judges in the Ronald Tannur case.
“Because Ronald Tannur’s case is still active, meaning it does not yet have permanent legal force because there is still a cassation appeal from the Public Prosecutor,” Suharto emphasized to Indonesian MediaMonday (2/9). “In carrying out supervision of judges, the Supreme Court must not reduce or interfere with the judge’s freedom,” he added.
Suharto said this was because there is a principle that a judge’s decision is considered correct until there is a higher court decision that overturns it.
“The Supreme Court is concerned that the panel of judges in the cassation case will be affected in their freedom to try the case, if the Supreme Court immediately responds to the recommendation,” explained Suharto.

Suharto also asked all parties to be patient while waiting for the cassation process at the Supreme Court. “Hopefully, the Surabaya District Court will soon send the cassation file,” said Suharto.
Previously, the KY recommended that the panel of judges at the Surabaya District Court handling the Ronald Tannur case be dismissed because they were proven to have violated the Code of Ethics and Guidelines for Judges’ Conduct (KEPPH).
KY also asked KY to bring the ethical case to the Judges’ Ethics Council (MKH) to follow up on the recommendation to dismiss the judges.
“Imposing heavy sanctions on reported party 1 Erintuah Damanik, reported party 2 Mangapul, and reported party 3 Heru Hanindyo in the form of ‘Permanent Dismissal with Pension Rights’,” said the Head of the Judicial Supervision and Investigation Division of the KY, Joko Sasmito. (J-2)
