The DGCCRF has in recent days imposed administrative fines on several companies, sanctions of a relatively modest amount, except one, of 1.1 million euros targeting M6, for non-compliance with payment deadlines to their suppliers. According to a statement of sanctions published on the website of the Directorate General for Competition, Consumer Affairs and Fraud Prevention on Wednesday, Metropole Television was fined 1.1 million euros on 26 last April.

For their part, the pharmaceutical laboratories Servier received a fine of 220,000 euros the same day.

In early May, the restaurant brand McDonald’s France was fined 200,000 euros, while the companies Alliance Automotive and Abeille Asset Management, received 100,000 euros and 75,000 euros respectively in fines, announces the DGCCRF.

On Wednesday, McDonald’s France affirms, in a brief statement sent to AFP, “to have explained” to the DGCCRF that “the cases (of payment deadlines not respected) reported focus on periods of confinement linked to the management of the pandemic. of Covid-19. “The organization of the company was, like all companies, disorganized in the implementation of (its) payment procedures”, continues the brand, regretting that “the administration did not take into account of these major external constraints”.

Fines can be up to 2 million euros

Among the other companies sanctioned in early May: Zambon France (55,000 euros), Axa Investment Management (45,000 euros), Hellio Solutions (40,000 euros), CS Comlandi (26,000 euros), Prada Retail France (15,000 euros). Since 2009, the law has capped inter-company contractual payment deadlines, which cannot exceed 60 days from the date of the invoice, or 45 days from the end of the month – but specific deadlines are provided for certain products. or services.

The fines, increased in 2016, can go up to 2 million euros for a legal person and 75,000 euros for a natural person. They can be doubled in the event of a recurrence within two years. In its last report published in June 2022, the Observatory of payment terms indicated that only 41% of companies, including 75% of SMEs, paid their invoices on time.
