The Lula government is said to be studying other ways to regulate social media before the 2024 election. The goal is to approve, by October of this year, rules for the digital election campaign, so that they can apply in next year’s municipal election.
According to information from the newspaper Folha de São Paulo, the government would already be articulating itself to place its priorities in a mini electoral reform to be voted in the National Congress, in addition to changes in consumer law laws.
This would be a government “plan B” after the Bill No. 2630/2020also called Fake News PL, have had their vote postponed and there is no short-term forecast for the text to be voted in the National Congress.
The government’s objective is to approve some changes in the internet by October of this year because, by the principle of annuality, to be valid in the 2024 election, all changes need to be approved at least one year before the election.

Among the measures analyzed are: shorter deadlines and higher fines for platforms to remove certain content in the periods immediately before and after the election and the ban on online electoral propaganda in the period.
In addition, big techs must maintain libraries of political announcements in real time, with greater transparency. The National Consumer Secretariat (Senacon), of the Ministry of Justice, should also be more used to frame the platforms.
Senacon issued an ordinance, on April 12 of this year, after attacks against schoolswhich provided for the suspension of activities in Brazil on social networks that do not take measures to combat content that advocates violence and threats.
The idea is to sign TACs with all platforms. The government is still awaiting a decision by the Federal Supreme Court (STF) on two appeals that may lead to a relaxation of the Civil Rights Framework for the Internet. The definition was scheduled for June, but it was postponed.
