The president of the board of directors of the Senate of Mexico, Alejandro Armenta Mier, presented an initiative to repeal the General Law of Transparency and Access to Public Information and to disappear the National Institute of Transparency, Access to Information and Data Protection (Inai ) so that their functions can be carried out by the Ministry of Public Administration.
The initiative had been published in the Gaceta de la Cámara de Senadores, but it was taken down without explanation hours following its publication.
Armenta Mier argued that the INAI and the SFP share objectives and activities, so there was the possibility that the Institute would be absorbed by the Secretariat so that there would be only one entity responsible for the transparency of public information, as well as data protection. personal in Mexico.
The senator assured that the INAI is an autonomous body whose objective is to guarantee people’s access to public information and the protection of personal data, while the Public Function has a mission aimed at ethics, honesty, efficiency, professionalization and transparency of the public function in accordance with the legality and regulations established in the National Development Plan.
The initiative sought to change the current text of article 3 of the General Law for the Protection of Personal Data Held by Obligated Subjects and the text of article 37 of the Organic Law of the Federal Public Administration.
The first change would make it known that the effects of the Law will be dealt with by the Ministry of Public Administration, while the second would specify that the same Secretariat corresponds to the “office to deal with” requests for public information.
Armenta Mier’s initiative caused controversy and criticism from the opposition and human rights organizations, who claim that the proposal puts transparency and access to public information in Mexico at risk.
In turn, the INAI issued a statement in which it rejected the initiative and stated that its disappearance would affect the protection of personal data and access to public information, as well as the accountability of the authorities.
Organizations such as Article 19 and the Mexican Institute for Competitiveness (IMCO) expressed their concern and rejection of the initiative, pointing out that the disappearance of INAI would weaken the fight once morest corruption and transparency in Mexico.
Given the controversy generated, Armenta Mier announced that the initiative will be reviewed and presented in a new version, which will take into account the comments and criticism received.
The senator pointed out that the intention of the initiative was to seek optimization of resources and efficiency in public management, but recognized that the disappearance of INAI is not the solution and that it is necessary to strengthen its autonomy and functions in terms of transparency and protection of personal information.
