Li Jiachao’s late submission of consent form for election advertisements

The Chief Executive, Li Jiachao, who won the 6th Hong Kong Chief Executive Election, filed a petition with the High Court on June 8 this year, stating that when he ran for the election, he did not submit 3 election advertisements as required by the Electoral Affairs Commission. A letter asking the court to exempt him from punishment. The Court of First Instance of the High Court held a hearing this morning (18th) to deal with the originating summons. The judge issued a judgment at 4:30 pm today following the judge asked both parties to clarify part of the written submissions. The court issued an order exempting Li Jiachao from being punished for breaching the requirement to give consent on time, but ordered him to pay regarding HK$64,000 in legal costs for the case.

The applicant in this case is Li Jiachao, who did not attend the hearing today. The respondent is the Secretary for Justice. The respondent added today that the applicant is willing to pay the costs. According to the originating summons submitted by the applicant to the court, the applicant violated the Electoral Procedure (Chief Executive) Regulation and failed to submit the application within one working day on April 13 and 17 this year as required by the Electoral Affairs Commission. The consent form of the relevant parties for the election advertisements published on the 18th and 18th. The applicant is now requesting an order from the court exempting him from the above requirement and from being punished for breaching the requirement.
