Legal proceedings against Charles Wright: Me Salifou Beavogui doubts the “impartiality” of the judge

Prosecuted by the leaders of the FNDC for acts of “slanderous denunciations, defamation, public insults and abuse of authority”, the Minister of Justice, Alphonse Charles Wright was conspicuous by his absence at the opening of the trial, this Thursday, June 22 2023, before the TPI of Dixinn.

At the end of the first hearing devoted mainly to the setting of the bond, the plaintiffs’ lawyers expressed concerns. “The hearing has just ended. What happened in court indicates the future of this case. My clients and I now have apprehensions, we have the feeling that the law will not be said in this case. The direct citation is a procedure that allows any citizen to prevent the prosecutor or the gendarmes and the police from destroying a case. You will go directly to the court of judgment to have your case heard. It is this procedure that we have borrowed. The first hearing is devoted to setting the bond. The deposit does not impose itself as a decree, or an order, it is not a unilateral act. The president comes into the room, he calls the file, he says that the day is devoted to fixing the deposit. He sets the bail at 1 million GNF and sends the file back to June 23, 2023 by relocating the trial to the Court of Appeal. So the court came with the decision ready,” explained Me Salifou Béavogui.

And to add: “A judge cannot come with a written decision. We did not have the opportunity to discuss the deposit and the recovery period. That’s a right for us. We are not in penal summary how we can come into a courtroom we do not give the floor to the parties, we set the deposit, we send the case back as we want and we take a date as we want. That is to say that if we start a requisition procedure we will not have time to do it because tomorrow is the trial when the president will receive the file” lamented the lawyer.

However, Me Beavogui does not intend to give up. “All this is to tell us that this case will be nipped in the bud, but I warn you the Tribunal of Dixinn is not the only one in the Republic of Guinea. There is the Court of Appeal, the Supreme Court beyond that there are the international jurisdictions so the law must be said. But the way this trial has been handled today, we have the feeling that we will not have a fair and just trial”, he worried.
