Legal Battle Between FIFTY FIFTY and ATTRAKT: Updates and Royalty Issues

The problem between FIFTY FIFTY and ATTRAKT management continues to roll in court. Previously, the K-Pop girl group, the Cupid singer, filed a contract suspension lawsuit with ATTRAKT. The legal process recently proceeded to mediation.

FIFTY FIFTY parties represented by the mothers of Saena and Aran attended the mediation process on August 9, 2023. In that process they were met with ATTRAKT, each of whom was also accompanied by attorneys.

Mediation and discussion took place for two hours. Unfortunately nothing came out of the process and it was declared a failure.

The court then scheduled a second mediation on Wednesday (16/8/2023). But today, each FIFTY FIFTY member wrote their opinion which was read out by the attorney. In that article they emphasized their lack of desire to mediate or make peace with ATTRAKT.

Therefore, the legal process will continue to trial. It is not clear when the next trial will be held.

The conflict between FIFTY FIFTY and ATTRAKT made them unable to be active in the music industry for a while. Not only that, the royalties obtained from Cupid’s song must also be withheld until the trial problem is over. This was stated by the Korea Music Association (KOMCA) some time ago.

KOMCA usually pays royalties every 4 months for musicians. It’s just that for this FIFTY FIFTY case, they chose to withhold all the money generated from Cupid’s song because the copyright issue for the song is still ongoing in court.

This copyright issue started with ATTRAKT’s lawsuit represented by CEO Jeon Hong Joon to The Givers, a company that became their collaborator in the production of FIFTY FIFTY and Cupid. Currently, The Givers on behalf of Ahn Sung Il as the producer holds the highest percentage for Cupid’s song royalties.

The copyright to the song Cupid is owned by The Givers (as a company) by 66.85 percent, Ahn Sung Il (as an individual) by 28.65 percent, and several other names involved including a company employee (4 percent), and Song Ja Kyung or Keena is a member of FIFTY FIFTY (although only 0.5 percent).

The Cupid song itself was bought by Ahn Sung Il from music school students for 9 thousand US dollars. The original composers have benefited from this success since the songs were copyrighted.
