As Lina Nemeikaitė, the representative of the Vilnius District Court, told BNS, G. Danėlius, along with lawyers Dainius Baron, Valdas Rakauskas and businessman Antans Petrošius, were fully acquitted.
According to the court’s verdict, the mentioned persons were acquitted of all the criminal acts charged once morest them, and the written promises not to leave were canceled.
Judge Virginija Pakalnytė-Tamošiūnaitė, who passed the acquittal verdict, left the civil lawsuits of the four victims named in the case for the award of non-pecuniary damage unexamined.
The verdict can be appealed to the Court of Appeal of Lithuania within 20 days.
The prosecutor of the General Prosecutor’s Office, Rimas Juodis, who supported the state prosecution in the case, told BNS that the possibility of appealing the verdict will be evaluated following getting to know it.
“When we get to know the decision and its reasons, then we will evaluate what decisions to make. (…) The law provides for a period of 20 days”, said the prosecutor.
G. Danėlius, who was acquitted, told BNS that he expected such a verdict, that he felt calm regarding the factual circumstances in this case – to the lawyer, they “didn’t seem at all incriminating”.
“All the time when you’re dealing with STT, all you expect is to walk through the side door, not some factual circumstances. My research is regarding STT officers walking in the side door anyway, and when you say it out loud, they choose the best defense – an even bigger attack that overshadows that message. They simply failed”, said G. Danėlius.
When asked to specify what he meant by walking through the side door, he claimed that he knew that one of the STT officers had gone to the judge who decided on the pretrial order of G. Danėlias’ client.
“Such STT walks, in my opinion, are illegal and scandalous. STT tried to cover up this information and message I provided by initiating a pre-trial investigation once morest me. (…) I think that he will really use the power he has and use all the opportunities to continue attacking”, said G. Danėlius.
15 min collage of archive photos/Giedrius Danėlius, a lawyer who himself received accusations from law enforcement, hopes for justice in court.
At that time, in the comment of Giedrius Murauskas, the managing partner of the Noor law firm, which was transmitted to BNS, the firm said that it “didn’t doubt its colleague”.
“Today the Vilnius District Court acquitted our colleague, lawyer and partner Giedrius Danėlias. We never doubted our colleague and supported him all the time. Giedrius is highly valued for his impeccable reputation as a lawyer,” said G. Murauskas.
The public prosecutor’s office sought to bring the famous case lawyer G. Danėliu to justice for possible illegal influence on the former director of the Special Investigation Service (STT) Žydrūnas Bartkas and investigator Vilija Kerbelienė.
The General Prosecutor’s Office requested that G. Danėlių be found guilty under four articles of the Criminal Code, which provide for liability for illegal disclosure or use of information regarding a person’s private life, abuse, threatening a civil servant and obstructing the official’s activities.
The prosecutor’s office also wanted 75 thousand to be allocated to the lawyer. EUR fine, deprivation of the right to practice law for five years.
The prosecutor asked V. Rakauskas to be found guilty of unlawful disclosure or use of information regarding a person’s private life, threatening a civil servant and abuse. It was proposed to allocate 50 thousand to the lawyer. EUR fine and deprivation of the right to practice law for four years.
The prosecutor requested that lawyer D. Baronas be recognized as guilty under the same articles of the Criminal Code as V. Rakauskas, and that he be fined 25,000. EUR fine with a ban on practicing law for three years.
According to the case, at the beginning of 2020, in order to terminate the pre-trial investigation regarding the National Blood Center, the defendants allegedly tried to influence STT officials by informing the service regarding intercepted confidential official data, private information regarding the personal life of one of the officials.
The defendants denied their guilt both during the investigation and in court.
G. Danėlius defended Raimondas Kurlianskis, the former vice-president of MG Baltic, who was sentenced to six years in prison in the case of political corruption by the Court of Appeal, as well as the mayor of Anykščiai, Kęstutis Tubis, who was acquitted by the Supreme Court due to influence peddling.
