The Labor Directorate (DT) began this Tuesday, April 25, a nationwide inspection program at 114 stores of the Líder supermarkets of the Walmart Chile chain to verify that the employment contracts of the employees of this chain comply with the labor regulations and contemplate the specific functions to be carried out in supermarkets by workers.
The inspection program seeks to verify the complaints made by federations and unions of the company that oppose the figure of the “store operator”, a new category of workers with multifunctional performances that -according to Ordinary No. 1722 (25 /06/2021) of the DT- does not comply with the law because it does not grant a minimum of certainty to the workers regarding the work to be carried out in supermarkets.
The 114 inspections that will be carried out during May will cover Administradora de Supermercados Hiper Ltda. and Administradora de Supermercados Express Ltda. stores throughout the country
The Director of Labor, Pablo Zenteno Muñoz, started this inspection program in a supermarket in the center of Santiago. The authority explained that “the matter that we are monitoring, at least since 2011, has been declared illegal by the Labor Department, precisely because it violates article 10, number 3 of the Labor Code. And, in that sense, this is a show that has been repeated. This is the second time that we are carrying out a program in this company, and it has a broader scope, because indeed we continue to receive complaints regarding the fact that this labor legislation continues to be violated”.
Meanwhile, the Undersecretary of Labor, Giorgio Boccardo Bosoni, pointed out that “as a Ministry and Government, in order to fulfill our commitment to advance Decent Work, it has been essential to strengthen and improve inspection work. In this sense, this inspection program aims, which seeks to verify whether or not the contracts actually comply with the regulations, and that if they do not, then we will proceed to apply to the company the sanctions that the law establishes.
Boccardo announced that “during May, following the execution of this control plan for more than a hundred Walmart supermarkets, we will announce the results to those involved in this evaluation, to the union organizations and to the general public; with the aim of promoting that it is everyone’s responsibility to safeguard good labor relations”.
Inspection procedure
The audit includes interviews at their workplaces with workers whose contracts were modified by signing annexes that expanded the number and type of functions they must perform in their shifts. Likewise, it includes the delivery by the company of the respective contract annexes to compare this documentary information with that delivered verbally by the workers.
If violations are detected, companies will be penalized with a fine of up to 60 Monthly Tax Units. In pesos, this amounts to $3,784,440 (at the May value).
In this sense, the president of the Federation of Walmart Workers and in charge of the Commerce branch of the CUT, Karen González, stated that “we know the precariousness that the position of ‘store operator’ is bringing, where people are being exploited (…) Walmart is the first with the position ‘store operators’, but this is affecting all businesses, different brands, which we are also representing”.
