The Indonesian General Election COMMISSION (KPU) will persist when undergoing dispute trials or disputes over general election results (PHPU) at the Constitutional Court (MK). So far, member and Coordinator of the Legal Division of the Indonesian KPU, Mochamad Afifuddin, said that his party had formed a PHPU resolution team at the Constitutional Court for the presidential and vice presidential elections and legislative elections.

“The KPU team consists of an internal team at the KPU ranks from central to district/city level and an external team, namely legal representatives or lawyers,” said Afif when confirmed, Thursday (7/3).

The KPU, he continued, also identified and took inventory of legal problems that occurred at the provincial, district/city level, and even incidents at the polling station (TPS) level. The handling scheme prepared by the KPU is to conduct a case once morest the application submitted by the applicant.

Afif confirmed that his party had made preparations from the start in dealing with PHPU by preparing internal and external teams, carrying out petition reviews, and preparing internal standard operating procedures (SOP) for the management of handling PHPU cases at the Constitutional Court.

“Our position is that whoever makes the postulate must prove it. So, we defend or show evidence to ensure that what we are doing is in accordance with the rules,” he said.

Separately, member of the Indonesian General Election Supervisory Agency (Bawaslu) Totok Hariyono admitted that he had asked his regional staff to prepare written statement materials to face the dispute trial at the Constitutional Court.

According to him, the initial materials for all stages of the election, from campaigning to vote recapitulation, need to be prepared from now on and written in the monitoring results report.

“We should also not get involved in conspiracies to pass or not pass alleged violations,” concluded Totok. (Tri/Z-7)
