At the 11th plenary session of the 410th National Assembly (regular session) held at the National Assembly in Yeouido, Seoul on the afternoon of the 9th, the partial amendment bill (alternative) to the Trade Union and Labor Relations Adjustment Act, also known as the Yellow Envelope Act, was passed with 298 registered members, 174 present, 173 in favor, 0 against. On the 13th, the People Power Party plans to request a power dispute adjudication at the Constitutional Court against National Assembly Speaker Kim Jin-pyo, who accepted the withdrawal of the impeachment bill, in relation to the Democratic Party of Korea’s re-promotion of the ‘impeachment bill against Korea Communications Commission Chairman Lee Dong-kwan’.

The People Power Party’s legal support group plans to file a request for a power dispute adjudication to the Constitutional Court this morning. An application for a preliminary injunction to prevent recurrence of the impeachment proposal during the regular National Assembly session is also scheduled to be filed at the same time. It is reported that Rep. Jeon Joo-hye, head of the legal support group, will submit it directly to the Constitutional Court.

The ruling and opposition parties are fighting over the interpretation of Article 90 of the National Assembly Act, which states that ‘when withdrawing a bill or consent on the agenda, the consent of the plenary session or committee must be obtained.’

The Democratic Party claims that it is only a simple report and that it can be withdrawn without the consent of the plenary session.

On the other hand, the People Power Party believes that due to the nature of the impeachment bill, which has a clause that it will be discarded if it is not processed within 72 hours after the report to the plenary session, it becomes an agenda item immediately after being reported.

The People Power Party’s position is that the impeachment bill after 72 hours has been virtually rejected, and that it cannot be re-submitted during the regular National Assembly session (December 9) in accordance with the principle of one-shot-no-one.
