Koksijde’s Second Home Tax Upheld: Investing in Affordable Housing and Attracting Permanent Residents

The tax levied by the seaside municipality of Koksijde on second homes has been validated by the Ghent Court of Appeal. The aim of this tax is to act on real estate pressure to attract new permanent residents, as well as to invest in social housing.

In mid-June 2020, owners of second homes in Koksijde were asked to pay 1,168 euros. Their challenge failed the first time before the Bruges district court, but they appealed.

“The fact that this tax also aims to finance investments in social and affordable housing confirms the municipality’s objective of making permanent occupation possible through the tax, not only by encouraging owners to rent their accommodation to a person who registers with the municipality, but also by providing affordable housing”, we can read in the judgment of the court of appeal.
