The Khyber Pakhtunkhwa government has taken a U-turn on the Police Amendment Bill 2024. The Police Amendment Bill 2024 presented in the provincial assembly on October 16 was withdrawn five days later and the amended bill was passed by the House instead.

On October 16, the Police Amendment Bill 2024 was presented in the Khyber Pakhtunkhwa Assembly for approval.

According to the said bill, appointments and transfers in the police were to be made under the rules and regulations of KP government, 1985. According to the proposed bill, the IG of Police could not appoint DPOs at will. If the Chief Minister wanted, he could delegate his powers regarding appointments and transfers to the IG.

The IG was empowered to appoint and transfer Grade 17 and Grade 18 officers.

According to the bill, an Independent Police Complaints Authority was to be established, which was to be empowered to punish police officers, this authority was to consist of 6 members.

Under the proposed bill, the chief minister had the power to appoint and transfer police officers above grade 18.

It may be noted that the provincial government had rejected the reservations of the police on the Police Amendment Bill 2024, and now its replacement bill has been approved.

According to the new bill, it will be mandatory to implement the Chief Minister’s measures related to law and order, two members of the Safety Commission will be appointed as observers for the purchase of police equipment, and the Chief Minister should be kept informed about the general and special issues of the police. will

According to the bill, approval of the Chief Minister will be mandatory for police transfers of grade 18 and above. Under the new bill, sections 21, 24 and 37 of the Police Act, 2017 have been deleted, removing the Additional Sessions Judge in the Public Safety Commission. MNAs have been included, 7 MPs in the Provincial Bulk Safety Commission will be appointed by the Speaker of the Assembly, 4 of the 7 MPs will be from the government and 3 from the opposition.

According to the bill, the government will appoint 7 independent members in the Provincial Public Safety Commission. A minority independent member will also be included in the Public Safety Commission.

A Public Safety Committee will be established at the Peshawar level to register complaints, the members of the Public Safety Commission will be appointed for 4 years.

A complaint authority will be established at the divisional level for police complaints.
