The sixth correctional chamber of the Hainaut court, Mons division, pronounced the guilt of the four police officers prosecuted for failure to assist a person in danger following the death of Simon Bachelet, a 26-year-old Frenchman who died on July 16, 2016 following of an overdose. They benefit from the suspension of the pronouncement of the conviction for a period of three years.
On July 16, 2016, Simon, originally from Dordogne, consumed LSD during the Dour festival. A young Douroise admitted selling LSD to the victim at the festival, saying he never wanted what happened to Simon.
He contested the aggravating circumstance that this sale caused a death. The causal link has been questioned, due to the absence of traces of LSD in the victim’s blood. However, the court finds him guilty and he is sentenced to 300 hours of labor. If not executed, he will go to three years in prison.
From dismissal to conviction
Arrested by the police and taken to the police station, Simon became delirious in the cell, screaming, banging on the walls and even drinking water from the toilet. He died in the followingnoon. No police called for help.
The four police officers had benefited from a dismissal in the council chambers. They never considered that such a tragedy was going to happen.
Me Mayence, the lawyer for Simon’s family, had strongly insisted that the police be sent back to court, believing that they had committed a fault by not providing assistance to a young person in danger.
“He was left naked in a cell for five hours. We let him bang his head once morest the walls, put his head in the toilet, before dying of hypothermia, without receiving any help”, Me Mayence accuses the police of having lied. “They filmed Simon’s ordeal, for fun”.
The court followed the arguments of the criminal lawyer. Convicts have 30 days to appeal.
