The Federal Chamber of Criminal Cassation rejected the attempt by former President Mauricio Macri to continue with the recusal of the interim federal judge of Dolores, Martín Bavawithin the case for illegal espionage to relatives of crew members of the ARA San Juan.

The objective of the former president’s defense was move forward with the challenge against Burralready rejected by the Federal Chamber of Mar del Plata, with the aim of being able to nullify any decision made by the magistrate in the file in which he was prosecuted.

“I have come to let you know that without prejudice to the disassociation ordered by Mr. Judge Dr. Martín Bava in this case, our interest and grievances for his intervention in the proceedings are still valid”remarked the lawyer of the former head of state, Lanusse.
“If the challenge discussed here is granted, all the acts that the person named would have practiced since our proposal could be declared nullwhich is why I request that the treatment, analysis and resolution of this appeal remain in force,” he added.

After knowing the decision of Cassation, the lawyer Valeria Carreras, representative of one of the complaints of relatives of crew members of the ARA San Juan, considered the measure as positive. “Former President Macri wanted to continue his attack on Judge Bava,” he said.
And added below to finish: “Today there is a glimmer of hope in that jurisdiction in which this lawsuit does not trust, today they have rejected the request to continue with the challenge. We will continue fighting for truth and justice.”
