The judge of La Plata Guillermo Atencio, rejected the exemption from prison for the 48 employees of the Buenos Aires Legislature whose bank cards were in the possession of the PJ leader, Julio “Chocolate” Rigau, who was making withdrawals from an ATM, at the time of being detained.
For now, the 48 legislative employees are witnesses in the case cited by the Prosecutor’s Office that is investigating a sequence of scams whose protagonist is Rigau, who on September 9 was detained by the Police at an ATMfollowing the officers were alerted by a homeless person who was struck by the fact that the man was inside the ATM area of Banco Provincia for several minutes.
The owners of the bank cards have so far been summoned to testify as witnesses by prosecutor Betina Lacki. Everyone, in one way or another, failed to provide information to determine the true origin of the money. and some said that “in confidence” they gave their card to Rigau so that he might make money withdrawals.

In his resolution, with which he rejected the exemptions from prison, Judge Atencio took into account that the crime investigated “widely exceeds eight years in prison.” and, therefore, considers “the extent of the damage caused and the characteristics.”
“From the conduct investigated here, significant guidelines emerge to show that, if a conviction is imposed, it will have to be effectively complied with,” he remarked.
Atencio also appreciated “the number of acts perpetrated, the high amount of money defrauded from the public treasury – a sum that until now amounts to eight hundred million pesos; the duration in time; the activity carried out by the accused, insofar as it facilitated the commission of acts of corruption in the exercise of public office; the certain possibility of influencing co-defendants taking into account the personal link between some of them and the expected sentence, due to the arithmetic sum of the maximum sentence of the crimes investigated.”
Rigau is arrested for various scams following being caught at the ATM with the 48 cards and more than a million pesos in cash.
The Prosecutor’s Office aims to determine the origin of the money and is going in that direction by taking testimonial statements, for now, from the owners of the cards, but also in the expertise on the cell phone of the PJ leader.
