Update The Nanterre prosecutor announced Thursday the opening of a judicial investigation for intentional homicide targeting the police officer who fired the shot that led to the death of Nahel on Tuesday in the capital of Hauts-de-Seine and requested his detention.
“The prosecution considers that the legal conditions for the use of the weapon (by the police officer) are not met”, estimated in front of the press the magistrate, Pascal Prache, adding that the police officer, aged 38, was presented before two Nanterre investigating judges with a view to his possible indictment. “In view of the facts and the need to preserve the investigations, the prosecution requested his placement in pre-trial detention”, underlined the prosecutor.
Circumstances of the drama
During his press conference, Mr. Prache detailed the circumstances of the tragedy, following hearing the two police officers “several times” and exploiting surveillance videos and amateur videos broadcast on social networks. According to the first elements of the investigation, the two police officers on motorcycles wanted to control the car which was traveling at high speed “on a bus lane” in Nanterre, he described. They signaled the driver to stop at a red light, but it started up once more. The car “continued on its way” followed by the two bikers, before getting stuck in traffic, according to Mr. Prache. The two police officers then dismounted and “yelled to the driver to stop” by positioning themselves “on the left side” of the car, “one at the level of the driver’s door, the other near the ‘left front wing’, according to the prosecutor.
Guns pointed at Nahel
During their hearings, they said they “both took out their guns” and “pointed them at the driver to deter him from starting once more”, he said. “As the vehicle restarted, the police officer near the vehicle’s fender shot the driver once,” fatally hitting him. According to the autopsy report, Nahel died as a result of a “single shot which went through the left arm, then the thorax, from left to right”.
At the same time, the French Minister of the Interior, Gérald Darmanin, announced the mobilization of 40,000 police and gendarmes this Thursday evening, including 5,000 in Paris alone. The triggering of the state of emergency is however “not an option considered” at this stage by the government, despite the numerous riots in the Paris region.
Gérald Darmanin also specified that the police officer concerned was administratively suspended until further notice. The Minister of Justice, Éric Dupond-Moretti, meanwhile denounced those who “spit on the police and the justice system”.
