“Judicial Ban on Demonstrations: PTB and Engagés Express Serious Objections”

The PTB and the Engagés have expressed serious objections to the judicial ban on demonstrations that the government wants to make possible. They fear that, in this way, fundamental rights are flouted, and demanded on Wednesday to hear the unions. A request that did not garner majority support. This ban would apply to troublemakers who have already made themselves known during demonstrations. It follows rallies that degenerated and led to skirmishes and destruction, for example in 2021 and 2022 against corona measures. The ban would only apply to a limited set of offenses such as destruction, violence against police and journalists, and setting fire to a protest, for a limited time.

In opposition, the Engagés and the PTB were reserved when the bill was presented by the Minister of Justice, Vincent Van Quickenborne. Vanessa Matz (Committed) and Nabil Boukili (PTB) wanted to hear the unions. The PTB also suggested inviting a constitutional expert.

The deputies put forward a critical opinion, emanating from the Federal Institute for Human Rights which points to “important issues” on the need for such a measure. According to him, the social necessity of the sentence which would be imposed does not appear when offenses such as willful destruction or assault and battery already exist.

The Minister pointed out that such a measure came into being at the request of mayors like that of the City of Brussels “because of the breakers“. “This is a minority that makes life impossible for 99% of protesters“, he pointed out.
