Josef Fritzl, the Austrian who held his daughter captive for 24 years and raped him, is transferred to a ‘normal’ prison under conditions. His lawyer had asked for early release.
Correction: An earlier version of this article stated that Josef Fritzl would rather freecome. It later turned out that he was being taken to a regular prison. This has been adjusted.
An Austrian court ordered the conditional transfer of 88-year-old Fritzl on Thursday, news agency reports WHAT.
The conditional transfer means that Fritzl will be transferred to a regular prison. The Austrian had been held in a high-security penitentiary psychiatric center since 2009. Fritzl is allowed to remain in normal prison on the condition that he undergoes psychotherapy.
The court’s decision is not yet final, reports said The press. There was no representative of the Public Prosecution Service present, which means that the judiciary now has fourteen days to appeal.
Fritzl’s lawyer requested early release earlier this month. She had him undergo a new psychiatric examination. This would show that he is no longer dangerous. He is also said to suffer from dementia.
According to the lawyer, Fritzl has the right to a “dignified existence”. It would be better for her client to stay in a nursing home than in a prison.
Fritzl’s lawyer therefore wants to submit a request for Fritzl’s full release next year. She says her client’s daily life will not change with a transfer and that he will still have to undergo psychiatric evaluations in a regular prison.

Lawyer Fritzl: ‘Court no longer finds him dangerous’
Fritzl kept daughter captive in cellar for 24 years
Elisabeth, who had been abused by her father since she was eleven, was lured into the cellar beneath the house when she was eighteen. Fritzl held her captive there for 24 years. In 2008 he was exposed because his daughter managed to come into contact with the police.
During the period mentioned he fathered seven children by Elisabeth. Fritzl insisted to those around him that his daughter had run away from home to join a cult.
Fritzl has been in a high-security penitentiary psychiatric center since 2009. He is serving a life sentence there. He received this not only for holding down and raping his daughter, but also for his role in the death of one of Elisabeth’s seven children.
Elisabeth and her six living children have taken on a different identity.
