Jollydays in bankruptcy: What voucher holders can do now

As the credit protection association KSV1870 announced on Friday, bankruptcy proceedings have been opened against the company and its sister company Jollytec at the Vienna Commercial Court. The liabilities amount to around 8.6 million euros, and a total of ten employees are affected.

The Viennese company specialized in arranging adventure activities. It sold vouchers for thousands of different experiences. These were redeemed by the respective experience provider after booking on the Jollydays website.

The news of the bankruptcy caused uncertainty among many consumers who still have Jollydays vouchers. The Upper Austrian Chamber of Labor (AK) answers open questions about the bankruptcy proceedings:

1. Since when has the AK known about the problems at Jollydays?

In July, the first consumers complained to the Chamber of Labor that Jollydays vouchers were not being redeemed. For example, a sightseeing flight, a boat trip, a romantic dinner or a trip in a Maserati did not take place because the respective provider refused to redeem the voucher. According to the consumers, the providers did this because they had not received any money from Jollydays for months. The AK consumer advocates wrote to Jollydays GmbH, but the letters remained unanswered.

2. What are the consequences of declaring bankruptcy?

The bankruptcy court appoints a lawyer as insolvency administrator. This lawyer must decide what happens next with the company. During the bankruptcy proceedings, individual creditors may not be favored or disadvantaged. The redemption of individual vouchers is therefore no longer possible. All information on the bankruptcy proceedings is published in the insolvency file.

3. What can voucher holders do after bankruptcy?

The purchase contract for the voucher is with Jollydays GmbH. The respective experience provider is therefore not obliged to redeem the voucher. Voucher holders can register their claim in bankruptcy proceedings until October 10, 2024. A fee of 25 euros must be paid for this. However, it depends on the amount of the claim and the outcome of the bankruptcy proceedings whether these costs can be recouped with the bankruptcy quota at all.
