Prosecutors accuse Jennifer Guilbeault, a 23-year-old New Yorker, of perpetrating a hate-fueled assault by pepper spraying an Uber driver in an alarming anti-Muslim attack on the streets of New York City.
A new report released by the Leadership Conference Education Fund reveals troubling trends indicating a rise in hate crimes, particularly during presidential election cycles, highlighting the need for vigilance against intolerance.
A woman has been formally indicted on multiple charges, including second and third-degree assault as a hate crime, for an unprovoked attack that involved pepper spraying a 45-year-old Uber driver in New York City earlier this year, according to prosecutors’ statements.
Jennifer Guilbeault, 23, faces serious legal repercussions outlined in a New York State Supreme Court indictment, which includes one count each of second-degree assault as a hate crime, third-degree assault as a hate crime, and second-degree aggravated harassment, as disclosed by the Manhattan District Attorney’s Office. Prosecutors assert that Guilbeault’s actions constituted an anti-Muslim attack that unfolded on the Upper East Side in July.
The incident reportedly occurred at approximately 12:15 a.m. on July 31. At the time, the driver was in the midst of completing a ride for Guilbeault and another passenger, who was seated in the back of the vehicle.
According to the district attorney’s office, as the driver paused at a red light, he began praying in Arabic—a gesture that apparently provoked Guilbeault. Prosecutors allege that she “lunged forward toward the driver’s seat, holding a can of pepper spray” before using it to spray the driver directly in the face.
The impact of the pepper spray left the driver with severe burning sensations, redness, and pain, prompting him to call 911 just moments after the assault, as per details from the district attorney’s office. Guilbeault was subsequently arrested at the scene, marking the rapid response from law enforcement.
New York City television station WPIX reported in August that Guilbeault was arraigned on these serious charges but maintained her denial that the attack was driven by racial motivations, an assertion that contrasts sharply with the evidence presented.
In a firm statement on Monday, Manhattan District Attorney Alvin Bragg condemned the attack, stating, “As alleged, Jennifer Guilbeault senselessly assaulted a Muslim Uber driver while he was just doing his job.” He emphasized the right of every individual to live and work without facing hatred or discrimination in Manhattan.

Disturbing Pepper Spray Assault Captured on Camera
The Uber driver, identified as Shohel Mahmud by several media outlets, conveyed to CBS New York and WPIX that he perceived the assault as racially motivated, further revealing that he has reduced his working hours due to safety concerns following the incident.
Dash camera footage, obtained by local television stations, vividly depicts the moment of the attack, showcasing Guilbeault lunging forward to spray Mahmud directly in the eyes. The footage also shows her physically grabbing Mahmud’s arm while he attempts to push her away, underscoring the chaotic nature of the situation.
In a moment of desperation, Mahmud can be seen unbuckling his seatbelt and trying to exit the vehicle before swiftly returning as it begins to move. In a show of resolve, he puts the car into park while the second passenger helps to restrain Guilbeault.
When questioned by the second passenger about her motives for the attack, Guilbeault allegedly remarked, “he’s brown,” a statement that has drawn widespread condemnation and highlighting the disturbing nature of the incident, according to representatives from the New York chapter of the Council on American-Islamic Relations (CAIR-NY).
Nation’s Largest Muslim Civil Rights Group Strongly Condemns Attack
CAIR-NY, which represents the largest Muslim civil rights and advocacy organization in the United States, expressed its approval of the indictment against Guilbeault in a statement on Tuesday, marking a significant step towards justice.
Executive Director Afaf Nasher stated, “We welcome the hate crime charges in this case and thank law enforcement authorities for sending a clear message that those who allegedly carry out bias-motivated attacks will face the consequences.” Nasher also pointed to the alarming rise in anti-Muslim incidents occurring nationwide.
According to CAIR, the group documented a staggering 4,951 bias complaints across the nation between January and June of this year, representing a staggering 69% increase compared to the same timeframe in 2023. Their assessment highlights a growing trend of violence and discrimination against Muslim communities.
Earlier this year, CAIR reported receiving what was described as the “highest number of complaints it has ever received in its 30-year history,” with a total of 8,061 complaints documented in 2023. Alarmingly, nearly half of these complaints emerged in the last three months, coinciding with the escalation of violence in Israel and Gaza in October 2023.
